What does construction insurance cover?

Common policy elements of a construction insurance policy include:

  • Public liability insurance – or PL insurance as it’s also known, forms the basis of many construction insurance policies.  It protects you/your business should a member of the public be accidentally injured or their property damaged because of your work.  Construction often involves working in public spaces, and as accidents do happen, most construction firms see this as an essential cover
  • Employers’ liability insurance – or EL insurance, protects employers from compensation claims from their employees should they be sued for loss or injury at work.  If you have people working for your building firm, be they full-time, part-time, or contracted, then having employers’ liability insurance cover is a legal requirement.  Failure to have a policy in place can lead to a £2,500 fine for each day you are without it.  In law, the health and safety of your employees is essential, which is why you are legally required to protect your business from incidents such as:
    • Someone having an accident at work
    • A member of staff developing a medical condition through their work
    • One of your employees having their property damaged at work

    Your policy must:

    • Cover you for at least £5 million of liability cover – construction firms often have policy limits of £10m or even higher
    • Be through an authorised insurer
  • Professional indemnity insurance – if you give clients advice – even routine advice like which products or which materials to use on a job – then you should include professional indemnity insurance as part of your construction insurance. It protects you against claims for loss or damage made by clients or third parties because of the impact of negligent services you’ve provided or negligent advice you offered
  • Product liability insurance – if you recommend or supply a product and it fails, even if you didn’t manufacture it, then you can be sued for damages.  Working in construction means recommending and using products all the time, so you and your business run a constant risk of legal action if something goes wrong with a product
  • Joint Contracts Tribunal insurance (JCT insurance) – if you’re entering JCT contracts to do renovations for a homeowner, a commercial property owner or some large-scale job with a developer, then you’ll want to have JCT insurance in place.  JCT isn’t a single policy but a collection of covers that can be arranged when a JCT is in place.  Depending on the size and complexity of the job, JCT insurance can include cover for things such as:
    • Contract works – also called contractors all risks (CAR insurance) cover or JCT Option C – contract works insurance protects you against risks like fire, theft, vandalism, and accidental damage to materials
    • Owned and hired-in plant insurance – if you own or are hiring in plant equipment such as diggers, mobile lifts, or welfare units, owned and hired-in plant insurance will cover you if they are lost, accidentally damaged or stolen, and can even cover ongoing hire fees
    • Delay in start-up insurance – DSU insurance as its sometimes called, protects you against any financial losses that occur because of a delay in the project’s completion
  • Tools insurance – including for tools left in vehicles overnight
  • Materials cover – including for materials being stored off-site by your client
  • Carriage of your own goods insurance – covers a vehicle’s contents including tools and materials while being moved or stored overnight
  • Plant and hired-in plant insurance – also known as construction plant insurance or construction fleet insurance, you can insure plant equipment such as diggers, cranes or welfare units, whether these are owned or rented
  • Business interruption insurance – if a project grinds to a halt for some reason, such as a flood or a fire, for example, business interruption insurance will provide you with an income and cover your expenses until the project can get going again
  • Structural warranty – provides building owners with ten years of protection from ‘latent defects’ to the structure of a building.  Latent defects are ones that occur during the build period but aren’t discovered until after it’s been completed.  Structural warranties are usually bought by the builder or developer, but this warranty will provide cover for the person who purchases the completed building
  • Contractors’ all-risks insurance – known in the trade as C.A.R. insurance, this can cover all the risks you or your construction firm faces on one policy.  From materials and projects in progress to public liability and employers’ liability cover, it gives you complete peace of mind
